On our last business day of 2024, Jones + Associates were successful before the Queensland Court of Appeal in overturning the convictions of a client.
Our client was originally convicted of two counts of fraud after a seven day trial before the Cairns District Court. The appeal was successfully argued on two basis, being in effect:
- The jury was not properly directed as to our client’s state of mind, which is required to be assessed by the jury in order to render him liable (or otherwise) of fraud;
- The prosecutor mislead the jury as to the laws of ownership of a company.
This Court of Appeal success is a fitting end to a busy and successful year for Jones + Associates.
