here are a number of different types of offences of dishonesty offences captured within the Queensland Criminal Code, including but not limited to:

• Fraud;
• Money laundering; and
• Corruption.

These types of offences are broadly described as “offences of dishonesty” or “white collar crime”. The most common of these type of this offence is Fraud.

Fraud

Fraud is the offence of applying the property of another person for your, or someone else’s, benefit in a manner that is considered dishonest to the ordinary person. A person must have done this both intentionally and dishonestly.

If convicted for the simple offence of Fraud under subsection (1), a person is liable for 5 years imprisonment.

The maximum penalty will increase to 14 years if any of the following aggravating features are present:

• The offender is a director or officer of a corporation, and the victim is the corporation; or
• The offender is an employee of the victim; or
• The property was subject to a trust agreement, and was dealt with not in accordance with the terms of the trust;

• The offender benefited, or caused a detriment of at least $30,000 but less than $100,000; or
• The offender is/was an employee of the victim.

The maximum penalty will increase to 20 years if any of the following aggravating features are present:

• The offender benefited, or caused a detriment of at least $100,000; or
• The offender carries on the business of committing the offence.

Offences of dishonesty can be difficult to both prosecute and defend due to their often complex nature that often includes significant business and financial records.
