n Queensland, wilful damage is a serious offence under the Criminal Code Act 1899.

The intentional and unlawful damage or destruction to another person or company’s  property can include graffiti, vandalism, smashing windows or any deliberate act that results in harm to tangible assets.

If charged with this offence, the prosecution must show that the property was damaged with intent and not by accident. Further, the damage must have occurred without the owner’s consent. Defences can also include that the damage was caused in an emergency when someone was in danger of death or serious injury OR that the damage occurred under duress or compulsion.

Simple wilful damage offences can incur a penalty of up to five years imprisonment but there are also special cases of wilful damage where the penalties are significantly higher including:

• Destruction by explosion – life imprisonment
• Damage to an aircraft or railway – 14 years imprisonment
• Damage to an educational institution – 7 years imprisonment
