Significant Result in Perth District Court Drug Importation Matter

By November 3, 2026No Comments

Jones + Associates has recently finalised a significant Commonwealth drug prosecution in the District Court of Western Australia, bringing to an end a matter that had been ongoing for approximately three years.

Our client was originally charged with the importation of more than 500 kilograms of cocaine.

The prosecution arose from an Australian Federal Police investigation into the retrieval of a substantial quantity of cocaine that had been dropped from a container ship as it passed the Western Australian coast.

The AFP alleged that an initial attempt to retrieve the drugs was unsuccessful after the vessel being used broke down. A second vessel was launched two days later and successfully retrieved the drugs and brought them ashore. Police subsequently seized the drugs from a nearby residence and arrested three men, before charging them with importation of the drugs.

A further three people, alleged to have been involved in the unsuccessful first retrieval attempt, were later arrested and charged with attempted importation offences.

The Proceedings

The two men arrested with our client entered pleas of guilty and were each sentenced to 22 years’ imprisonment, with 14 years to serve.

Our client elected to contest the charge.

The trial commenced in the District Court of Western Australia on 20 July 2026 and was expected to run for between six to eight weeks. Our client was tried alongside three other accused alleged to have been involved in the first, unsuccessful attempt to retrieve the drugs.

A number of significant legal issues arose during the trial. These included an application that there was no case for our client to answer, together with an application seeking a stay of the proceedings.

During the course of those arguments, the prosecution offered a resolution which involved our client pleading guilty to a lesser charge.

Following careful consideration of the offer and the circumstances that had developed during the trial, that resolution was accepted.

The trial continued for the remaining three, who were all found guilty by jury and are currently awaiting sentencing.

Sentencing

Our client’s sentencing proceeded over two days, on 13 and 19 October 2026.

Extensive material was placed before the Court on his behalf, including affidavit evidence from family and friends and a number of expert reports.

Our client was ultimately sentenced to nine years’ imprisonment, with eligibility for release on parole after five years.

Having already spent approximately three years in custody awaiting trial, the result means that our client is required to serve approximately a further two years before becoming eligible for release on parole.

The outcome was particularly significant when viewed against the sentences imposed upon the two co-accused who had earlier pleaded guilty, each of whom received 22 years’ imprisonment with 14 years to serve.

A Significant Outcome After Three Years of Litigation

The result brought to an end approximately three years of complex litigation involving a very serious Commonwealth prosecution and significant potential consequences for our client.

It also demonstrates the importance of continuing to critically assess the prosecution case throughout a criminal proceeding.

Commonwealth proceedings are such that the strategic position of a case can change considerably as evidence is tested, legal arguments are determined and a trial develops. In this matter, the legal issues raised during the trial ultimately created an opportunity for a substantially different resolution of the prosecution.

Our client was extremely pleased with the outcome.

Jones + Associates acted throughout the proceedings together with Mr O’Brien KC and Mr Rawlings of Counsel.

Commonwealth charges can involve complex legislation and carry substantial penalties. If you or someone close to you is facing these charges, obtaining experienced legal advice early is important to understanding the case against you, identifying available defences and making informed decisions at each stage of the proceedings.
